Question about Suing someone in Texas?
I sold a washer and dryer on ebay, the guy came and picked them up this weekend, we hooked everything back up so he could test them - he took them home and the washer isn't working they way he wants it to. He's saying it won't aggitate when he has a lot of clothes in there - I know it always worked when I used it, but it's an older machine, it's used, and it's refurbished. Anyways, he threatened to go to ebay and that he has lawyers, I'm concerned that he could try and sue me - everyone I have talked to says that's the luck of ebay and because he was able to test it, I'm not liable, but I'd appreciate any advice!

Get your washer back, give him his money back and sell it again. Whatever a used washer is worth is less than the expense and headache you may go through.
As long as you put on ebay that the items were used & you will not garuntee how long they will last you are solid & theres nothing that can be done. When selling anything used, you always need to make sure you have marked visible that the items are being sold used with no warranty expressed of any kind. The way your listing on Ebay was listed & the way you wrote it up, depends greatly upon whether or not he could have a legit complaint & if anything would be done, either by Ebay, courts, or anyone else.
