A company I purchased something from hasn't picked up their returned goods. Can I keep them?

I purhcased a coffee machine from a UK retailer and it was damaged on delivery. They have since replaced the machine but did not pick up the original machine. I have told them about this and it has now been 4 weeks since I last chased them and it is now just getting in the way. What rights do I have here - how long are can they take to pick it up - can I just sell it?!

You should make sure that you write to them informing them that the goods are available for collection at a mutually convenient time, you should provide them with contact details to arrange a mutually convenient time and ensure that you have proof that they received the letter (i.e. recorded delivery). Within the letter you can give them a reasonable time limit for collection, such as 28 days.

If the goods are damaged I don't see why would you want to sell/keep them.


You can't sell it! At least not without telling them first.
But you don't have do do anything else with it after informing the owners that you have it.
You could send another e-mail to them after a month and say you will sell it if it is not collected in, let's say, 2 weeks.
Just sling it in the garage.
You can't keep them, because they had it on record. When the time they need it back and you do not have it, then they charge it from your account. So, don't be so greedy to keep something that doesn't belong to you.
I'd tell them to come get it or I'm going to sell it.
do you know their address? It should be on the package.. send it back to them with a "nice little note".
Its not your responsiblity to chase them to collect their stuff. Put it somewhere safe till you feel that they dont want it back because its not worth their time to collect it.
my mum had a similar thing happen to her.she bought a wardrobe set from argos and had it delivered.before it was delivered she changed her mind and got a refund. a few days later the wardrobes were delivered. she explained to the driver but he said he could only deliver them and she should contact argos.she did this and they said they would collect it within 10 days this was a year ago so now she has found a use for it. i would say if you have made reasonable effort to get them to collect it and they don't then more fool them.
I would imagine it will not now be picked up. but sods law will apply if you sell it the next day someone will come to pick it up.

send a short note saying if not picked up in seven days you will dispose. then sell it problem over
