I loaned money to a friend about 4 or 5 years ago. Can I still get it back?
I loaned about $800 to a friend to help her out with apt rent and car replair but she refussed to pay back the money and said those were gifts. Can I still get the money back legelly? I don't have any contract nor agreement but I do have all the returned checks.
If yes, How?

Well you could sue in small claims court. You have no proof of a verbal agreement or anything on paper, so it will be an uphill battle. Even if you win, you are not guaranteed any money. You will then have to attach wages or property to get anything. As it has been several years, I would just take the loss and the lesson. Never lend money to friends or relatives. It is best to just give it to them.
If you've got something in writing with her signature stating she owes you for a loan, there's a chance you could take her to court. However, since you have let it be for 5 years, the judge will most likely dismiss the case and think you're just bringing it back up because of a grudge.
When will people learn.when you help friends or relatives just write it off in advance..i bet you have no note signed
You can take her to small claims court, but without any signed paperwork it's iffy. I'm sorry she turned out not to be a very good friend.

never loan more than you can afford to lose!
It is sad to see the end of a friendship becuase of these things.
Your friend should pay it back on his own, without being taken to court!
You can try, but I doubt you would be successful!
If you don't have a contract/written agreement/witnesses, you can take legal action in small claims court but there is no way you can prove that this person didn't pay you back at all without a legal agreement defining interest and repayment so it is doubtful that you'll get much (if anything) back after legal fees.

Send her an email Saying "Do you remember when I loaned you that 800. and add a funny story unrelated to the money, just so she will answer, Once she does you will have her confession of the money you Lent her in writing and then take her to court.
