I want to re release a song but modify it.?

i was listening to a song and thought its been some time since this came and it was quite a big hit the first time round.my partner is a DJ and thought it would be funny to modify it...however we stumbled upon quite by accident a fantastic remix that would absolutly kick off especially in the clubs. it actually sounded better. Now can anyone re release a song that has been modified? do you have to wait a certain amount of time from when it first origionally came out? i would love any information about this!

just call it a remix, or re-remix, as long as you don't sell it for profit, you should have a problem!
