Am i entitled to dla i was awarded it for life in new zealand been refused in uk twice?

hi i was awarded dla in new zealand for my daughter who has had heart surgery and is left with severe asthma and on steroids for the rest of her life she is 5 now and my gp says she should be on dla as she is not allowed to participate in any school sports needs put on her ventilator frequently but i have claimed in uk and been refused twice why is this can anybody help

Hi, you can appeal, look at www.benefits and work.co.uk, packed with information and guides that will give you a very good idea of they way they expect you to answer and how to describe ongoing but fluctuating probs - it is very difficult to claim here and as your daughter appears to attend a mainstream school, although unable to participate fully, I wouldn't hold out too much hope unless you need adaptations and aids eg car and at home, apart from portable ventilator - is it a nebuliser? or is it necessary for her heart condition?

Have a look at the site (some is free to access and some subscription) but there are forums as well where you can ask questions of welfare and benefit experts - try to keep your GP and consultant on side. Good luck ! - you may be able to claim attendance allowance, I think carers allowance would probably be out of the question - as you are the parent and she is sill a minor.


Why would she get DLA because she can't do school sports - sorry don't get that.
The sad fact is that they only take so many cases on, your either on the list or not. It is hard but that's how they operate, if two similiar cases are alike, they might only pick one.

I know you may not want too, but if your daughter recieved dla in New Zealand and you do need the money to look after her then the option might be to return back, as then you may be able to get the dla once more.

Also, it depends on how you wrote the dla form out, they have a certain way in which they want it, if it is not done in the way they want then it is refused. If you can not return back to new zealand and I can understand if you are settled here, then try a third form and really say exactly what your daughter needs and how her life is effected. Tell them what you have to do with her and what she can not do, put as much detail as humanly possible. It can also help to have backup from specialists who have seen her and can really see what she needs, you need to gather as much proof as you can and send it with the form. Make the specialists write a report. Whateevr you send, always make copies.

If that does not work then go to the citizen's bureau, or somewhere where you can ask for help in filling out the form properly. Do not leave anything out, say as much as you can, evne if you go over the boxes in the form, you tell them just what its like and how much care she needs etc.

Finally, if nothing happens then try to seek some advice from every available place, your doctor should know where the best places to seek advice are, if he / she is any good.

Also look for anything that is not the DLA, but something else that can give funding, they must be something on the internet other then DLA to help your daughter.
its very hard to get DLA in the UK, there have been crippled people here that were taken of DLA because they were now able to stand. Asthma isn't classed as a disability, if it was more than half of the UK would be claiming it. My father was on a constant ventilator before he died and had to fight for DLA.
