What is a Letter of Appointment?
I am looking for a definition or an explaination of what a letter of appointment. Is this like a POA (power of attorney)?
Answers:
Not in the current legal dictionaries, so I think the usuage varies by area/court. In some of my estate planninng legal books they refer to a letter of appointment being given by the probate court to a person that the court appointed to act as Executor for an estate. ( In cases where there was no will, or the executor named in the will cannot or will not perform the duties or the court won't let the named executor perform the duties of the office).
When the courts in Illinois appoint a Guardian Ad Litum (someone who temporarily represents a child or disabled adult) the letter to the attorny being appointed is titled Letter of Appointment.
My experience is that the letter of appointment is an appointment by the court. A POA is a document that a person signs, no court involvement.
In Mormonism, the letter of appointment is a controversial two-page document used by the supporters of James Strang to prove that he was the designated successor to Joseph Smith, Jr. as prophet and head of the Latter Day Saint movement.
