Can I sue for rotten food ?

my husband got a veggie juice from the supermarket but when he drunk all from his cup, he started to vomit because the juice was old and with kind of bubbles he had diahrrea and headache. Can I sue them ?

You can sue even if the juice was fresh and your husband enjoyed it. In fact, you can sue anyone at any time.

The question is whether you can win. In your husband's case, he might win a small amount, but not much. Diarrhea and vomiting are not pleasant, but they will not allow you to collect much. A jury might give you as little as a dollar for your troubles.


I should hope you immediately notified the store so they could remove the problematic bottles from the shelves so nobody else would get sick!

You can sue the maker of the juice or the distributor if they are the ones responsible for stocking the shelves and verifying the dates on the products as being current. If it is the store, you can sue them for the error.

Speak to a lawyer and find out for sure all of the gory details.
TO BR, to get a trial by jury, they'll have to deposit a fair amount of money, probably more than what they could sue for. My guess, not worse it. I like better the first answer, did you call the store so no one else get sick?
