How is child support collected if non-custodial parent is not working?

Every state has their own laws about child support. But, in general what happens is after a certain amount of time of nonpayment, the payor is called in for a hearing. If they show up, and they do not owe a lot, the judge can put them on a program through domestic relations to get a job. If they do not show up, a warrant is issued. When they get picked up, they go to jail. The judge decides how long and it gets worse the more times it happens. If one owes more than $500 when they file their income taxes, the refund is intercepted and used to pay off the bill. The person gets the rest in a separate check about 6-8 wks after they were supposed to get the refund. If it is not enough to cover what they owe, they set a court date. Also, their driver's license can be taken away. Sometimes the debt is put on their credit report. And sometimes it is sent to a collection agency.

Generally it is based upon minimum wage in there home state x 40 hours a week. So that they are still being held responsible even though they are not employed they can always get a job at a fast food joint. That is the only way most states can do it. Good luck.. you didnt say why they are not working...if its that they are on disability the state can order child support out of the disability they receive..if its that they are not working to aviod paying up then they will figure a amount at minimum wage like the first person said and when it adds up in back pay they will arrest them...then they will work from jail and some of that will go towards the child support
If the non-custodial parent is not working then hopefully he is collecting some sort of unemployment, disability or social security (child support is able to garnish wages from there-except from SSI) or if he is responsible enough, he will make an effort to make some kind of payment himself. If he does not pay at all then contact the enforcement office in charge of your case and ask for an enforcement hearing. (Im pretty sure if judge stipulates a warrant will be issued for his arrest if he does not make a payment by a set date the non-custodial parent will find a way to make money and pay!)
There is no excuse for a person not to pay his child support- There are hundreds of jobs available for anyone at any given time, the problem is that many people feel too proud to take minimum wage jobs or the not so glamorous jobs...
