Child support was lowered recently. why are the amounts different month to month. i thought they were fixed??
Answers:
Not quite sure what your question is without knowing more facts, but generally court orders do set a specific amount per month. However, if money is being withheld from a paycheck, the orders to your employer is designed to equal the per month order. If you are payed on a weekly or bi-weekly as opposed to a monthly or semi-monthly basis, the monthly totals will be slightly different depending upon how many pay periods you have in that month. Because a month is a little more than 4 weeks, the difference is made up when the extra pay period occurs (typically the thirteenth pay period which will be every third month if paid weekly or every six months if paid bi-weekly).
Nothing in child support or custody is "fixed". Either issue can be brought to the Court by either party for review at anytime.
If the non-custodial parent's income has changed, the Court can increase/decrease the support based on "a change in circumstances".
The amount can also vary month to month just on the way the local courts figure the amount. Say someone is ordered to pay $300. per month. Here, they multiply 300X12/52 weeks. If the payor gets paid twice a month then the formula would change to 300X12/26. It just depends on how the employer's paydays fall.Say the payor's employer pays each Friday. Some months have 5 Fridays, others have 4. But X number of dollars come out each Friday. In the math here, some months you'd get $276.92, other months you'd get $346.15. But over a year, it comes out to $300. per month
Do a search for Child Support Calculator for your state, i.e. Child Support Calculator Indiana. These sites will list all the variables for child support calculations.
Child support is calculated on a number of things, i.e., child's age, your income, regional cost of living, etc.
