Driving with teenager on a provision license.?

IN CALIFORNIA when you receive a provisional license (license for people under 18) there are two rules. The first is for the first year you cannot drive with passengers under 20 unless accompanied with a license person 25 or older and you cannot drive between 11pm and 5am. so what would happen if you are 16 with a license and you bring a couple of 16 year old friends with you in the car and you get pulled over? everybody i know says you get your license suspended but i dont believe that i think you only get a ticket. so what are the consequences? Remember I live in California (Los Angeles to be specific). I havent met anyone with a provisional license whos gotten pulled over with friends and my driving school didnt give me a straight answer.

Well, to be quite honest this question is akin to the illegal immigration debate -- its a matter of enforcement, not a question of legality. It is illegal for you to do any of the things you listed above, so that being said if you're worried about being caught violating them ... don't do it. The truth of the matter is enforcement of these violations is extremely lax ... the probability having these rules enforced on you is extremely low. However, there is still a possibility (however small) it could happen ...

When I was a Police Officer I would rarely enforce these violations to the letter of the law, unless there was a reason for me to do so ... usually I would give a warning and that would be enough. Scaring a 16 year old into the consequences of what could happen if they were charged with violating their probational license can be an effective deterrent (much moreso than actually enforcing it). Ethically speaking ... if you know you're not supposed to have passengers under a certain age in your vehicle, or be out past a certain time don't do it! If you don't want to get caught, don't break the rules in the first place.

An important provision to remember is that even with a provisional license you can drive past 11pm provided you are directly in route to your residence (with all haste ... meaning you're not going to stop at McDonalds or the gas station first). Just because it's 1 am doesn't mean you're stuck where you are if you have a provisional license, but you should also be aware that a Police Officer has the final authority in determining if you really are returning home with all haste (not you).

I should also mention I did enforce the restrictions on juveniles' provisional licenses ... not too many times, but I did. You don't want that to happen ... you won't be driving again until you're 18 (and you have to get a learners permit all over again).
