If a wifes assest are in her family's name and she dies ,including life ins. what rights does a husband have

I am not sure, but it depends on the situation. For example, life insurance -- in some states the spouse is required by law to sign the document if someone else gets the insurance payment other than the spouse. If you signed nothing, you may get part of it.

Likewise, if your spouse dies after you get married, but a will she signed or insurance is purchased before the wedding, you may be able to fight for these things in some states.

Finally, if you killed your wife (hey just covering all bases) then you are entitled to nothing in most states.

It is best to speak to a probate attorney.


If the assets are in the family's name, the legally, the husband has no rights to them.
You will have to fight for it and it will cost heaps you need a will for her or a good lawyer for you.good luck.
He has none if they were legally willed to her family as well as in their name.
No will?? Then no rights. . .

If everything, including the life insurance, are in someone else's name, then the husband is just out of luck.
