How can I make a non-arg. motion for judgement and motion for payment arguable? I'm in Ct.?
I'm being sued for a debt to Capitol One. I want to settle with them, and am working with credit solutions to handle my debts, but I haven't been in front of a judge yet. It's on the short calendar for Monday. What can I do?

The above answer is almost right - and is certainly correct in that you or your attorney must show up in court when the case is being heard.
Where it's wrong is in letting you think that anyone at the courthouse, including the creditor, will care about what you're doing with a so called credit protection company or a debt consolidator. You need to settle Capitol One's claim with them or their attorney. No one else matters.
If it's before the judge on Monday, then the judge is hearing arguments. Above all else, show up for the court appointment.
If you are trying to work out a settlement, you (or your attorney) can ask that the matter get continued while the settlement process is ongoing.
