I got arrested for a wrong reason and I want to sue the officers, how should do it?
I tried to sell a motorcycle helmet that my dad found and it turned out to be a set up by police. They charged me with felony of possession of stolen property. I spend 24hours+ in jail and was treated poorly. I barely got out thanks to the family. The problem is my dad and I told the same story to officers w/out lies, then why lock me up? And they took away the helmet with gloves and access. I want to punish those bastards. On top of that I think they messed up my record.

So what is the rest of the story? While what happened may not be right, police don't make that big of a fuss over a motorcycle helmet that some one found. If you feel something should be done, talk to a lawyer and find out your rights. But with what you are saying here, I don't believe you have much of a case. In fact you may have more problems if not careful.
call your lawyer and tell them you wanna sue someone. he/she will help you, and punish those police officers. good luck!
Sucks for you. Shouldn't be selling stolen stuff.
Get some money and call a lawyer.
You are right, if an accused person tells the cops that he is not guilty, then they should just let him go. Good plan. Arrest need not be correct to be lawful. If the cops found you in possession of stolen property, they did nothing wrong in arresting you. Notice that you have not been convicted of that offense. Nevertheless, if you think that the cops had no reason to arrest (that they must believe suspects) and that you have damages that you can prove, then read 42 U.S.C. 1983 as that is the basis for your lawsuit. BTW, something about your story makes me believe you are lying or withholding info, so you might want to change it a bit before you sue.
that blows, I would get a lawyer and see what action you can place.. never try to sue with out a lawyer it maybe cheaper but you'll be looked down on.. even lawyers get lawyers!!
if you have proof that the helmet was not stoled reguardless of stories and what was told have proof then they will see your side!
sadly with out PROOF your up a creek with out a paddle :( stories are not proof get a receicpt or some sort of recorded phone call!
Technolgy your dad should of posted it in the paper :::::Found helmet ::: call ####### to redeam your helmet!
for 30 days then you could of shown that at your case and maybe win!
well Good luck!
You were in possession of stolen property - the arrest may or may not have been necessary, but it was legal. Unless there's more to the story, you most likely would not have a case.
I've never heard of anyone "finding" a motorcycle helmet. They're expensive, and riders don't leave them unattended. If it was found inside or outside a business, your dad should have inquired if anyone had lost a helmet, then report it to police. After a due search for the owner, your dad may have been able to keep the helmet, then you could have legally sold it. Your dad was in the wrong, and you took the fall.
If you're pissed now, you'll be more pissed when the lawyers refuse your case (because you probably won't win and if you win you won't get much), and even more pissed with the judge when he kicks your case out of court. You will never get the satisfaction you are looking for so drop the anger and move on.
