Smoking in your own lorry?
My Hubby drives for a company But only He drives his own lorry, some drivers have said if no one else goes near him truck then he can smoke in it is this true. PS he is tring to stop just now but still want to no some facts about it,Also i drive a transit van with motorsport etc stickers over it ,its only the family run about but what happens if i keep getting pulled up in it.
Answer:
If he owns the truck he is allowed to smoke in it... If its a company truck that only he uses the company can ask for an exemption on his behalf stating that he is the only person ever using it.
If you keep getting pulled, log the date, time, officers name and number. once you have 5-10 incidents put in a complaint at the police station.
As far as i no as long as he has no passengers in the lorry he can smoke , but he can still be pulled over by the poilce for smoking in there now , thay will say his two hands are not on the wheel and its a distraction ,(this has even been before the ban came out ) , but i guess it all depends on his boss if his boss says he cant smoke in it because its a work van then he will have to stop smoking in it .
If your in the UK even though he is the only driver if it is a company van it is against the law to smoke in it.
Cannot smoke in an enclosed business area , which his cab would be.
you can smoke in a firms van or lorry as long as you are are alone its only illegal if more than i person is on board
