Part 2 of what can I do my bank account has been wiped out?
I feel really bad because the sister did not write the check someone sent it to her. I work in the proofing department of the bank and i ensured her that the check was okay to cash. I guess I was stupid for doing this for someone I never meant. She did not even ask me too do this. My daughter and son in law asked me to do it because she offered to help them pay there rent because the were in jeopardy of being evicted. She wanted to start her own bank account with the check and she told my daughter that they would have to wait until the check cleared but they wanted the money immediately for rent so they asked me. I said sure but they had to give me 300.00 dollars out of what ever she gave them so will that hurt my case in small claims court if a benefited from the check as well?
I took the wrap for what my daughter and i had out of the check.
instead of suing her for 4950.00 I want to sue her for 4150.00 is there any chance i can win this?
Answer:
You still have not said where the check came from. This can make a big difference. You can sue but think twice. Do you really want to sue a family member? Is it worth the destruction of your family? Given these details will they even be able to pay the judgement?
If this is one of those scams like the Nigeria thing, you need to report it immediately.
