Is taking pictures of a house harassment?

I recently took pictures of my ex's house to prove to the courts that he had to be grossing more than $1,500 a month in order to afford that houses along with another? I did not take the pictures myself but was with the individual who was taking the pictures. I never got out of the vehicle. He owns two houses one $368,000 the other $550,00 but yet he told the judge he only grosses $1,500 a month. I had the pictures taken to show he was lying about his income. That was in April. Last week, a sherriff came to my house and arrested me for harassment because he said I had no legitimate purpose for the pictures. I am now facing criminal charges. Is this really considered harassment? It was a one time deal only and I have never been back to his house since?

Unless there was a prior pattern of harassment and an existing restraining order against you, I don't see where these charges are coming from. It is a settled matter of law in every jurisdiction in the USA that I know of that anyone may take pictures of anything or anyone else on / from public property. You need no legitimate purpose to take pictures, you have the freedom to take whatever pictures you want for no reason at all.


If your ex didn't want the pics taken, then yes it is.

You were taking them to prove his income was more than what he claims it is. Besides, those pictures aren't going to prove anything - he could be renting them from someone, or they could be something he purchased with an inheritance - or an inheritance within themselves. Pictures prove nothing. Unless you have the deeds, and the papers that prove he is paying house payments on them, you have nothing.

But yes - it is harrassment.
