Can an employer offer insurance under his policy to 2 people in a office but not the rest?

I need to know if this is legal or not and if not where can i get proof it isnt?

An example is 25 people work in an office insurance is offered to exempt salaried personal only. Of those 25 people the accountant and the office manager fall under that category, everyone else is hourly and are not qualified under company policy.
