My apt. elevator malfunctioned causing me injuries should i sue?
Answers:
It depends on the level of the injuries. If you got a little cut and didn't need to see the doctor, then no. IF you broke an arm or a leg or worse, then you may want to talk to a personal injury attorney if you feel the need. Especially if you needed to go to the emergency room or need follow up care.
If you don't want to talk to an attorney, talk to the apartment management. They should have insurance. Make them file a claim. They should be paying for any and all medical care as a result of your injury.
If you already filed with your insurance carrier, let them know the situation. They will require you to pay them out of your settlement.
If it was because they failed to maintain it or fix it then most definitly, sue.
They have a responsiblity to keep you safe from stuff that can injure you or harm you; that is for stuff they own of course.
