Is it sexual assault of a child if a boy who is 16 and a willing to have sex with a woman twice his age?

(and now for the mindblower part) .but the boy did not know that there was an adult male hidding in the closet (possibly recording) and watching this take place for the man and womans sexual pleasure. I just found out about this and it happened approx 4-5 years ago in Texas. The boy did not know about the man in the closet who is twice the age of the woman and he is a district judge as well. Should they both be in trouble even though the boy wanted to have sex with the lady he was still only 16. And if so who could I tell because the authorities in this town are not willing to confront them for fear of losing their jobs. Serious answers only please this really bothers me.

If the people involved aren't upset, why are you? Is this your son? I think the whole thing is immoral but 4 or 5 years later I doubt anything could be done anyway. I wish i had a 32 year old when i was 16, I would be so proud!

I would call a 32 year old woman who has sex with a16 year old boy kinky, but certainly not criminal.

What I do think is abuse is that she and the man hiding in the closet were violating this young teenager's privacy by recording him; but as far as I know, that's not a crime although it probably should be.
The law in every stae defines an age of consentt, typically around 17 or 18.Until a person reaches that age, the law says that they do not have the legal power to consent to sex. So the answer to your question is yes it may be sexual assault, or even rape(statutory rape), and it happens all the time.

if the legal age of consent in your state/town is 16yo then he can do what he wants. however you also run in to statute of limitations on charges for corrupting a minor and child porn charges if they did things like sell the tape

Yup if 2 ppl have sex and 1 of them is older than 18 and the other is younger, the one who is older than 18 weather it's a boy of girl it is considered sexual assault weather it was rape or if they both agreed on it.
It doesn't matter which charge will come out of it. You need to report it to the Sex Crimes division of the Texas State Troopers. They will refer it to the proper jurisdiction.
On a side note, it probably isn't a sexual assault, but instead a child pornography charge.

Legally, the boy can't choose to have sex with this woman unless he's 18, which makes it statutory rape, and which means she knew better.
She could be prosecuted for statutory rape, and that creep hiding in the closet could also be charged as an accessory and an accessory after the fact. However, most statutes on rape run after about 6 years, but there are exceptions about childhood sexual abuse and other things, depending on the jurisdiction.
He might also be entitled to something in a civil suit -- for example, in CA, the law is that if you claim childhood sexual abuse any time before you turn 26.
The age of consent differs from state to state. You would have to find out the age of consent in the state where the incident happened. You would also have to have someone convince the boy, now a man, to testify against the people who took advantage of him. If nothing else, this man and woman, for their own warped, weird sexual pleasure, took advantage of this boy. Since the pervert in the closet is a District Court Judge, you could contact your States Judicial Watchdog Commission and report what you know to them. You can do it in writing or through an anonymous phone call. Go to your States web site and look up the information there. That is probably all you are going to be able to do. If the old perv in the closet was truly a District Court Judge, he should not be sitting in judgement of people on the bench.
contact your state attorney generals office if the police in your area refuse to help...also that is considered child pornagraphy ..which is a federal law so all in all you may want to contact the feds ....no statue on child porn...so you know
