Can they legally kick my father out of the nursing home if they make him private pay?
Answers:
Unfortunately, yes.
Yes they can.
having worked in many the answer would be yes
Yes.
yes If they determine that he is able to pay private pay and he does not pay his bill they can legally give him a thiry day notice to leave. He must exhaust his funds before the state will pay his bill for him.
yes, they can. sorry.
I am assuming that you mean if they make him private pay and he doesn't pay them. I think they can, but you really need to talk to an attorney.
Trust me, you don't want your dad there if he isn't paying, because if they can't kick him out, they can harass him when you aren't around.
If you are dealing with financial issues, you need to talk to the office at the nursing home. Nursing home care is SOOOOO expensive these days.
If your father is on medicare, and needs nursing home level care, and he cannot afford it, he can go on medicaid. You need to file paperwork on that QUICK.
Keep in mind that your father is legally allowed to keep some of his own money -- when I went through this with my father, who passed away in Feb., I didn't know that. We spent down to his last dime and were just filling out the paperwork to get on medicaid when he passed.
In your community, look for an Area Agency on Aging -- they can provide assistance to you in finding out these answers.
And feel free to e-mail me -- I can't help a whole lot, but I will do what I can based on my own experiences.
Yes. you have to spend all of your assets and show poverty to get state or federal assistance In most cases. Given the high cost of nursing home care, getting to the poverty level will take about 6 months to a year for many Americans.
