Would they let my friend into a bar after midnite if he turns 21 tomorrow?.. technically he'd already be 21..

Here's some legal trivia for you. Technically you are not the 'new' age until midnight (11:59 PM) on the date you were born. That means that if your friend was born anytime on the calendar date of July 29, he is not legally 21 until 11:59 pm July 29. This is because unless a person can prove exactly what time he was actually born, the law must take notice that someone could be 12 hrs, 2 hrs, 10 minutes, etc. short of the actual age. I'm not sure, but I think it's 'common law' as opposed to statute law. I've never heard of this becoming an issue at any time, but it could happen. Since this is not widely known (even by many in the legal profession) it is generally conceded that anytime on the birthday date can be considered the new age. If your friend went into a bar and had a drink any time after 12:01 am on his date of birth, he would probably be served and have no fear of being charged. Who the heck gets that technical, anyway! It depends on the bar ... but if they choose to not let your friend inside, there isn't anything you can do about it (except try somewhere else).
The answer is NO. It is not because he is "technically 21" but because the bar's Insurance Policy definitely WILL forbid it.
Most bars will, because technically after midnight the date changes. Make sure you get there about 11:30, so he's got to wait!
21 is 21 and if the date says he is 21 then your answer is yes, because..... he is 21 years of age. If they do not let him in, it the bar's choice. Just because you are 21 does not mean that somebody can not deny you alcohol.


When I waited tables, I was always informed to check the date. The date is the only thing that matters, not the time.

I think so it would already be his birthday and he would be that age. Tell him happy birthday and do not get too drunk, oh and do not drink and drive. Have fun!!
i would think he would have to show proof that he is 21 (drivers licens) and the dmv doesnt open untill 8:00 am and most bars are closed by then
It depends on the bar and the location. When I turned 21, there were only a few bars that would let you in at midnight on your birthday. And they marked your hands with a big "X" in permanent marker. And at one of them you could only drink beer. This was in a college town though, and there are tons of issues that bars in college towns deal with that other bars don't. A lot of places won't give you a hassle, but some might. Check with friends who may have turned 21 in the area, because they might know if there are bars that will hassle you about the situation. Although, technically and legally your friend is 21 since midnight is the start of a new day on the calendar.
