I have 3 questions...?

Im underaged.. but i dont drink..

If i was at a party && other people were drinking... & the cops showed up & i wasnt drinking at all... Would i get in any trouble?

What about if i was sober, but driving people home who had been drinking & i got pulled over?

Also, if a guy was drinkin, & i made out w/ him.. would it show up as me drinking?

Probably some stupid questions.. but im just wondering lol

In most cases, if there was a question of your sobriety, a Breathalyzer test can be conducted to clear you...on the spot. In the case of making out, I doubt that you would blow enough to show any alcohol consumption.

The other ones I'm pretty sure would be a no to you getting into trouble as well. As long as you hadn't been drinking and if needed were able to prove it.

1. Not likely, but your friends at the party could get accused for distributing to minors.

2. You may or may not. It depends on the state laws but drinking in a car is still considered open container.

3. No, it has to enter your bloodstream.
In theory, if you are not drinking at the party and are not in control of alcohol, you should not get arrested. But depending upon the law in your state, it may be an offense to be at an unsupervised party with open containers and underage drinking.

If you are sober, driving drunk kids home and there is no alcohol in the car, you will not get arrested unless in your state you cant drive after a certain time without an adult in the car.

Last part. No. BAC levels come from the lungs on a breatholyzer. The cop may smell it on you, but you will blow a 0 on the machine.

You can't be in trouble for being near other people who are drinking unless they are in your house and you are serving them.
You will NEVER get in trouble for being a designated driver and while your boyfriend's breath may have some alcohol in it, it won't be enough to throw your sobriety test off.
Insofar as your first question, if you were at a party and other people were drinking, would you get in trouble? Only if there was underage drinking and the others did something illegal which would give "cause" to the responding police officers. You could be implicated in the illegal behavior or deeds. If were were arrested, the worst that could happen would be violating curfew, underage drinking party and that your parents would be notified to pick you up from jail. However, that's a stretch.

As far a being pulled over, as long as the occupants aren't hanging their heads out of the window, have their seat belts on and generally being on their best behavior, and as long you are licensed to drive in your particular state, have current registration and insurance, there wouldn't be a problem. They could cite you for infractions such as illegal lane change or tail light out. Depending on your locality, your policed area may have a policy (where not legal), they could detain the drunk minors, arrest them and not charge them and notify their parents. As for you, I don't think so.

If you were to make out with a guy who had been drinking, a blood, urine or breath test would not show any measurable amount of alcohol in your system.
