I owe 6 months of Child Support totaling about $1100. Going to hearing. What can I expect?
I am going to a hearing for non payment of child support on the 25th. What can I expect to happen? I have been unemployed for the time I haven't paid, but have gotten a job recently but haven't started bringing money in yet. Should I expect to be put in jail? Payment arrangements? Just wanting some insight.
Answers:
The court looks at could not pay as opposed to WOULD NOT pay (you had the money but refused to pay) (jail) . Just explain and sign a repayment agreement - Suggest 20% above your regular payment.
NO if they know that you are working and you can prove it, they will just make you pay it.
I doubt that you will be put in jail. Go in there and explain that you have been unemployed but you fully intend to pay the $1100 and get current with your payments. Ask the judge if you can add extra on each month until you payback the $1100 deficit? Be sure to be nice and polite. It's never a good idea to piss off a judge. Dress in a polo and khahi pants. Be sure you don't look like a bum or the judge will think you are a deadbeat.
You should prepare yourself for jail time. Not saying that you will go to jail but I can't imagine it would be a good feeling going to court and not expecting to go to jail and all of a sudden the judge hands down sentencing.
You should make sure you have something to show the judge you were out of work, have a new job, and a commitment to catch up on the child support as soon as possible. If you have any money at all you should be prepared to spend it that day as a sign of good faith...Anything to stay out of jail!
you made the child, you have a responsibility. Be true to your responsibility and state facts .... don't BS. Take a paper and write all the tough times you have been facing with dates. Tell the judge what you have been up against.
Ask for a compassionate hearing, and make sure you are convinced about your commitment. Tell them about your new job and what you are making and what you plan to pay weekly.
Ask that you be allowed to make a weekly payment.
Take a check along to give as a part payment.
God bless your child.
Just keep dragging it out....... once you go to court - they will garnish your wages and they WILL take 25% no matter if you can currently pay or billis or not.
If you had been current on your payments until the job loss, this will help your case.
