Is there a difference between Culpable Homicide and Manslaughter?

Culpable Homicide exists in Scottish law, so does manslaughter, I think

They are broadly the same offence. Manslaughter where English law applies, culpable homicide in Scots (not Scottish) law. Other examples of different names for the same offences include arson (England etc.), wilful fire raising (Scotland) and burglary (England), house breaking (Scotland).


Culpable Homicide is an unlawful killing that lacks any premeditation or knowingly intending to murder, which would then class it as a murder.

In the United States that would be a charge of Manslaughter.

Basically these two charges are about the same, but in Scotland you can be sentenced to death if the charge is warranted.
