Do I have a case?
My fiance and I were at a reggae festival in Long Beach, California. And in order to purchase a beer you need a wrist band. We did not know this so these two security guard told us to go get the wrist bands and come back. After fighting our way through crowds of people and then getting turned away because we needed wrist bands, my fiance was highly upset at this point. so he told the guards men that we will not be returning to this festival next year. So after we left the area another security guard came from out of no where and got in my fiances face asked him with a real mean and devious look on his face"Do you have a problem?"And I said to myself he looks like he wants to fight him. My fiance said to him **** you and walked away. The security guard grabbed my fiance from behind as he is trying to walk off and put him in a choke hold. I got so scared that I'm trying to grab the guard off of him. And I started to tremble. Does anyone out there think that my fiance has a case to sue.

Well first of all I should let you know, many off duty cops work security for extra money. They can easilly do what they feel like since they are licensed peace officers. If he was just a security guard, then you need a little more info about what happened, because its hard to say if you do have a case. So far it doesn't seem like it. The question is why did he grab his wrist? What did your fiance do to make him do that? After him telling the guard ***you, that is known as disorderly conduct. The guard can either escort you off the property, get you for trespassing if you refuse to leave, or place charges for disorderly conduct. Without knowing all the details, I can't really say if you have a case or not. From what I see, it seems as if the guard was right in doing so. And if he wasn't then you would need to have enough proof to prove that he had no right. Unless you have it on video, or the guard say ok ok i was wrong, then you wont be able to prove anything.
sure do plus should have beat the wannabe cops a.s,s get a lawyer
Did you get proof? Snap a photo of him putting your fiance in a choke hold, or take your fiance to the doctor the next day? Otherwise, I don't think you have a case--it will come down to his word against yours, and there seem to have been bad feelings all around.
That said--write the city and file an official complaint. If anyone else has had problems with this guy, you may be able to get him fired, whether or not you could sue him.
If it is your word against the security guard, then you probably do not have a case.
If you had a cell phone that can take video pictures, and you sent those video pictures over the telephone to some place else (in case the guard seized your "camera") that would be evidence showing which security guard it was.
Sounds to me like the festival has a "system"
You pay to get in, and they issue a wrist band to show that you paid to get in, and then that is used to give you access various places ... or when people arrive and pay to get in, they show proof of age to get beer, and there is some marking on the wrist band to demonstrate that.
Well there's probably volunteers different places where there was a break down in their training.
You can write a polite note to the organizers, with what your grievances are and what you want from them
* your money back
* your medical expenses reimbursed
* apology from the persons involved
* they do proper training of their people so this not happen again to someone else
Give them time to respond, then if they refuse, you could go to the news media ... the festival wants good publiscity to get a crowd next year ... so that as the advertising starts next year, you again write the news media, all the places they do advertising.
Suppose they have an ad on some TV ... you write a letter of complaint to the TV station about the station accepting advertisements from this gangster organization & you include your evidence of how come you calling them that
They will pay you off to shut up
maybe
Find out from local ordinances to make it legal for you to do so
Then next year stand outside where the crowd is going in, hading out leaflets to warn the crowd of the risk to life and limb of what might happen to them like happened to you
They will definitely want to pay you for your pain and suffering to put a stop to that
Why couldn't the both of you just STFU?
I think your "bf" needs to learn some manners and learn to behave like an adult when he is out in public.
He sounds like he has more mouth than brains.
