What is the difference between an O.U.I and D.U.I?
I know that one is operating and one is driving. . . but what is the real difference. To me they are both the same and if any, which one is worse to be charged with?
Answer:
No difference, just semantics.
Just a mix-up with I.O.U. and I.U.D. !!
The same offense is called different names in different jurisdictions.
OUI could be just sitting in a parked vehicle, with the keys in the ignition while intoxicated.
DUI is actually driving the vehicle while intoxicated.
For most states/laws, they are the one and the same with little to distinguish between the two.
I believe the OUI charge can be used for those who choose to "operate" non-automobile devices, such as ATV's, while drunk. I also know some areas call it OUI, some call it DUI, and others call it DWI.
