Union Representation in the UK?

What are the laws surrounding union representation in the UK. My employer is refusing to recognise a trade union, basically saying if we join, they will not recognise them in any negotiations? Are they allowed to do this, if so, can anyone state any precedents or acts to back this up? I’ve had a look around but cannot find anything solid?

Answers:
Yes they can refuse to recognise a union. However if membership in your area is 50%+1 then your union can take the case to arbitration and they can be forced to recognise the union.

damn good question wouldnt mind knowing the answer to this too.

b.t.w how scared are your company of a union ? they sound terrified.

Great website. Its somewhere on this page - it is unlawful to not consult.

Hope this helps!
i think the unions had their lights extinguished by Maggie Thatcher and have never recovered they seem to have little influence now and perhaps they shouldn't have pushed so hard in the days of Scargill/Jones/ and the guy who accepted a Lordship and to Jack Jone's credit wasn't interested
To be honest, if I had started a business and risked my own money, I too, wouldn't want any left wing agitators bringing a Union into my business. If people are not happy with their employer, why don't they find another job? Sorry, if that sounds a bit direct, but I have generally found that those who want to get involved in introducing Unions tend to be a bit bolshy, and not the sort that you want working for you.
As a shop steward for a trade union myself, I can tell you that providing that you have a 51% majority in your work force in favour of bringing in a recognised union into your workplace, then the company in question will have to comply by law to bing a trade union to the work place.

If you do not achieve a 51% majority, then the company are not forced to do so.
Union Recognition - Employment Relations Act 1999

On 27 July 1999 the Employment Relations Act, the Fairness at Work legislation, became law. The Act is the most significant legislative advance for working people and their trade unions for more than 20 years. It shifts the balance of legal rights at the workplace.

This leaflet deals with the new legislation on trade union recognition which came into force on 6 June 2000.
