If a company wrongly delivers an item to you. How long after reciept does that item become yours?
Company involved sent me an item I didn't order then billed me for it. Naturally I got them to refund me and offered to return the item.
The company then said that they would send a return post carton so I could return the item without it costing me anything.
That was a couple of months ago. I offered once, I'm not gonna phone them up and offer a second time.
I know there's a law about wrongly delivered items becoming the householders property after a certain period of time.
But how long?
Answers:
Assuming this is UK, you have told them that you have this item, you have given them due notice; after SIX WEEKS it becomes yours under the unsolicited goods act.
If you don't tell them, it's six months for them to realise their mistake.
As they knew about this (you told them) and as you didn't order it (it was technically unsolicited), as this happened a couple of months ago, I think you can consider this item yours.
This is not dis-honesty, you have done all you are legally obliged to do, this is their mistake and the item is your compensation.
If they pursue the item now, tell them that it is yours under the terms of the unsolicited goods act and they should leave you alone.
Dell wrongly sent me 3 ink cartridges on two occasions.
I didn't get billed for them.
Naturally I used them for my printer. I weighed it up as being too much hassle for them to take me on for a few ink cartridges (circa £150)... but other companies might take you on if the value of the product is worth it. Either legally.. or if they are small company.. with other options. Don't rip off the little guy.
I wondered where my c0ck pump got to.
You got a package? Huh? What are you talking about? I never saw any package on your doorstep did you?
Get my drift?
BS, as soon as my door is closed it is mine and the company can suck it. The company has to have your signature on an order to press the issue.
i would hate to tell you a time frame. But what will happen is they will forget about it and then 3 yrs later you see something on your credit report for that cable company. I returned a cable box to a company and got a receipt that i dropped it off. 4 yrs later my credit report has 500 dollar charge on it from that cable company. I call them and they stated they have no record. And of course that long ago who has a receipt. It took me 4 months and 200 dollars to get that whole mess straighted out
What...do you want our OK for your dishonesty so that you feel OK about yourself? Send it back
Personally I would email them stating that unless they arrange collection within 7 days you will consider the item to have been donated to you freely and of their own accord.
Unless you actually make some effort to return the item or get them to collect it more than the initial contact they really have every right to chase you for it. However you could always charge them storage fees!
Be careful with keeping it; especially if they have already billed you for it. They will make a notation on your credit report and could cause MAJOR problems down the road when your credit score comes into play. However, if they don't have any record of the billing...keep it; lucky. :-)
This happened to me a few years ago - like you I got a refund and then asked them to pick up the other item which they never did! We kept it and then dumped it after about five years!!
