I need written proof that it is legal to tape a conversation in NY without other party knowing. Any help?

In NY it is legal to tape a conversation as long as 1 person in the party is aware that it's being taped. That person can be the taper if he is also involved in the conversation. However, it's not legal if a 3rd party tapes it & none of the people being taped know about it.
