After going thorugh a work related accident. what will fiing a workers comp claim do for me?

the accident was due to a supervising error, in which he (the supervisor) gave the order for a truck to leave the loading dock, however, i was still inside finishing unloading the truck. As the truck began to leave then i tried to step out but fell 5 or 4 feet from the loading dock to the ground. As a result my wrist hurts from trying to break my fall and my tailbone hurts as well because it was the main part of my body to impact the ground . Any advice will help.

Firstly, I hope you went to the clinic that your workplace uses, in order to document your injury. Secondly, an incident report should have been filed at your work. Did the clinic decide that you should not be working until your injuries are healed? If they did, then yes you should definitely file a workmen's compensation claim, as you will get 80% of your pay until you are able to return to work, after being off for a certain number of days. Start the ball rolling as soon as possible, that way you will be getting those checks quicker. Also, you have the right to seek your own medical help by using your own doctor, if you do not agree with the findings at the clinic. Make certain that you follow the orders of the doctor to the letter and if your injuries don't heal to your satisfaction, seek legal council. Hopefully you'll heal fine and be good as new in quick fashion.

What I don't understand, why didn't the truckdriver have to close the truck doors prior to leaving the dock? Sounds like the truckdriver didn't double check that his doors were secured, if he did he would have found you still inside the truck and his doors hanging open.

Good luck! : )

The laws vary from state to state. You should ask a local labor union about workman's comp attorneys.
Depending on the gravity of the accident, you will get compensated adequately!
You should have reported this to your supervisor already, didn't he or she see what happen?
(1) Report it to your supervisor immediately
(2) Fill out a Workmen's Comp form
(3) Go see a doctor, the Workmen's Comp will pay for any time lost due to injury, hospital and / or doctor visits relating to this accident
Go to a Dr. right away and make sure you take to your employer
with details...This will help the WC process better... If there's anything seriously wrong then pursue the claim , but if not I wouldn't bother because it will be a long drawn out process you and the company will go through and tension will build between you and them..

Consider what the company will do for you first..Like time off paying for medical etc. because WC is good for people who are really injured and not particularly with a client that just has superficial or minor injuries...

I went through WC many years ago and was given the run around for years..On the other hand my husbands case was
handled and settled within 2 years or so...He has a back injury that caused him to need surgery... He was awarded
30,000 in monthly payments over several years and future medical for life .. They paid for Doctors, hospital and wages... We nearly lost everything because their compensation isn't enough to get by but we did not have a choice...Not to mention them trying to get away with not paying on occasion.

So I say to you if you really need it use the system but if you don't then go to the top and and find out what they will do for you since it was managements error!
