What happens when a former cohabitating partner appears after the former partner's death to claim his estate?

The person who died left the estate to this former partner but didn't update his will to include his present partner whom he was planning to marry this August. Does either the former partner or present partner have any claim to his estate?

Answers:
This will turn on the law of the state in which the case arises, but generally if the person seeking to claim is not in the will and is not married to the deceased, that person is out of luck.
