In what type of case would you find a citation that read, the people of the state of california v. defendant jane doe?

Usually this would be a criminal citation.

However, there are some cases in which a state may sue one of its citizens in civil court.. such as for an injunction or for the recovery of money of some sort. In such a case, it would also be captioned like that.

Negligence IS a tort.. but a tort isn't necessarily negligence, either.
