No smoking law UK?

The new law states.. That we are not allowed to smoke in enclosed public places but we are ok in un-enclosed places. I work for an NHS trust. The hospital leases the land of of the local council. That must mean that it is public land. The NHS is a public body. Does it not follow that the hospital can stop smoking inside the buildings. I agree with that completely. But do they have a right to stop it in the grounds. Although they lease it. It is still public land. Used by a public body. I`ve tried lots of online places to ask the same question. As usual I never get an answer. Any thoughts on it??

No land owner can mark their land as non-smoking and make it smoke free under the new law. Not the council, not the NHS, not anyone, unless the government pass specific regulations about it. If a member of the public smoked in the grounds of your hospital they could be asked to leave, but not fined.

The reason YOU'RE not allowed to smoke is because the Trust are your employer and can tell you what to do. If you smoke, they'll discipline you. Many smaller and private companies across England have similar rules preventing smoking anywhere on their grounds, and they'd be within their rights to start the disciplinary process if the rule was broken.

So there's not a direct answer to your question really.


If the hospital lease it then they have the right to say what happens on it, which means if they say you cant smoke, well their isnt alot you can do.
the hospital by me has a no smoking sign as soon as u enter the grounds , but no one listens and does it anyway , im sure most hospitals try to stop it from being anywhere near there grounds
Most hospitals have smoking shelters that I have been to. It is an open space outside so shouldn't be banned unless people leave cigarette ends I suppose.

they stop you smoking in the grounds of the hospital so that they do not get dozens of people clogging up the entrances and exits while puffing on their fags and it stops the butt ends from littering the place up
The hospital lease the land and they have the right to say what happens on it. If they introduce the ban, you must comply with it or you will face the £50.
Yes, smoking can be banned on site altogether if they so wish including the grounds.
this question was raised over a year ago when the smoking ban first came in

it was raised in regard to public land leased to a local council for a school car park/
the answer was that the council did have a right to ban smoking, if you are really, really interested you could Google for it. East Renfrewshire council I think it was.

our local hospital has tried to ban smoking on its grounds but no one takes any notice of it. they have even tried to stop people smoking in their cars on the car park but again everyone just ignores it. it would cost too much to 'police' the area just to slap a couple of fines out
Legally they can't stop smoking outside the hospital i.e. on the hospital grounds, it's a rule not an enforceable law. However it is a common request, I'm sure, on all hospital grounds up and down the country, purely to promote health, more of a common etiquette.
It is such a pleasure to walk about without breathing in all that stinking second hand smoke. Smokers are most inconsiderate of others. I can't imagine smoking near where another person is. Dirty cig butts everywhere. The US has limited this affront to society for many years now. No more ruined meals in restaurants from stinking second hand smoke, on buses, trains, insides of cars are ruined, you can't get rid of the stink of cigs. By the way, there seems to be a fairly steady decline in cancer of the lung, lip, mouth, esophagus, bladder, and who knows what else. A whole lot less coughing and wheezing. I hope this helps. lol
The law states you mustn't smoke indoors - indoors is basically any structure with over two walls and a roof (ie, a closed in bus shelter is indoors, a free standing one is outside).

It's up the hospital whether they allow you to smoke on their private grounds though. I can't see why they'd say no?
It depends doesnt it. You dont want staff smoking in gardens that are designed for patients and their families. On the other hand other dedicated areas should be provided for smokers.
They should be given a private little courtyard or something.
Common sense and compromise by all parties has gone out the window.

Tell someone they can't do something and they want to do it all the more.

Suggest they shouldn't and good chance they won't!

If only politicians had a bit more common sense.
