How can I make my son's dad pay his arrears in child support?
I am sooooo frustrated with my son's dad. He is about 3 months behind in child support, going on four months now. He keeps giving me the run around every time I ask him for it. And just this last week, he moved from his tiny 2 bedroom apartment to a 5 bedroom house. He has a girlfriend who has 3 boys of her own who was living on welfare to support herself and her 3 children. How can he suddenly afford to buy a huge house and support someone else's kids but not his own? We have a court order that specifies how much he owes every month and garnishing his wages isnt helping because his job doesnt follow the order on the amount he owes so he gets most of the money from his paychecks that he knows needs to go to child support, but instead he spends it on himself and his girlfriends kids. What can I do? I'm getting so angry about this!
Answers:
You need to contact the court system and have his wages garnished.
Take him to court. The court will take a very dim view of his activities, and they'll take him right to the mat.
Is there a child support enforcement agency in your state? I received my child support directly from them. They also offer free legal services in regard to this.
Take this back to your lawyer and if your lawyer won't help, find another one. His job should be garnishing his wages and if they are suppose to be doing that, you can take action againsnt them also.
Good luck but you need to go back to court.
how can his job not follow the court's order for garnishment??
you need to stick with your court date and get your lawyer involved.
i wish you all the luck.
Take him back to court. Have him arrested, and that may give him a bit of motivation.
It is not illegal to have someone put in jail for failure to pay child support. My cousin just got out of jail for failure to pay.
Welcome to the world of child support! Its very frustrating, I know. You can take him back to court and if the amount is court ordered, ask the judge what consequences he faces by not paying. My state will take the drivers license away, then jail. good luck.
Take it to court.
But even that doesn't do aything except help line the lawyer's pockets... If he wants to shirk the responsibility, he'll find ways to avoid paying.
In the US its illegal to put someone in prison for failure to pay debts. So there's no "teeth" to any child support payment law.
He's found out how to get out of paying... Ye be screwed.
There must be a glitch somewhere. It sounds like it's with the employer's payroll dept., but this does NOT relieve him of the responsibility, especially when he KNOWS what he is to pay.
Contact an attorney, or his employer, your ex, or the court system. Mail a copy of the order (certified mail) to his payroll dept.
