Is this officer liable for ethics violations ?
A police officer has arrested a person for DUI . While the court case is ongoing the police officer tries to sell his house to the defendant . What ethics violation does this fall under ?
Answers:
As long as the police officer does not let the sale effect his court appearance and testimony, there should not be a problem. Especially if it is being sold through a real estate agency.
Conflict of interest. His local IA should be notified.
And the DUI case is now in danger of being dismissed.
There really is not a conflict of interest in this case. The DUI charge is made by the police officer, and the ruling on that charge is made by the circuit judge. As far as the house sale, it is an unrelated circumstance between the two parties involved. The sale of the house to the defendant is a seperate matter, not a connection to the DUI charge. As far as protocol and SOP are followed with the arrest, there should be no danger of ethics violations here.
Well, it all depends.
Is the cop offering liency or "a favor" in exchange for the purchase of his home? Did he seek out the person for the specific reason of selling the individual his home? If no to both, then I don't see where the violation is.
Typically, one doesn't always know who is offering to purchase their home. And with the circumstances being different, he may not even recognize the individual.
Is it a good idea to do? No. Is it wrong? Could be. But I don't see where there is a violation if there is no promise of favors or coersion involved.
