Can a employer fire you while you are out of work with work related injury?...state of Florida.?
Answer:
If you filed a valid claim under Worker's Comp, the answer is no. If you didnt, the answer is maybe.
yes...but most of them do get sued.
Contact J.P. Morgan of Morgan and Morgan...he is "for the people" and he is a freakin bulldog! Based in Orlando but works all over Florida...no cost unless you win.
Did you also file for FMLA? Even if it is work related you need to get an FMLA case number. Employers will try anything to get some people that they feel will not be useful to them in the future off the payroll as soon as possible. With FMLA you are guaranteed 12 weeks off without a reduction in your pay scale when returning to work. With workmen's comp it will take forever to get your case resolved, in the mean time you will not be having any income. Are you going to be completely disabled? This could change the entire situation.
