What is the Law for a Police officer, to search a California Residence, when the owners are gone.?
If the residence are in jail, due to a warrent, what reason would the police come back to the residence 10 hours later. When aproching and seeing another person on the property, they asked this persons questions like "why were they there," if they lived there, then asking permission to go into the residence and look around, that person said "no" due to the fact she, or he, had to legal right to give them permission. Yet the officers went into the home any way and not allowing that person to go inside with them. Is that wrong, or is that possible.? Could there be any probable cause, with out a search warrant? The two police officers were the same one's, that had taken the owners to jail, so they knew no one was there. There is a moter home on the property, and another person was arrested for under the influence of a controlled substance.

If the person that the police questioned was not convincing in their reason for being on the property then the police could assume that a burglary could have been attempted. That would have been sufficient probable cause. The admissibility of any additional evidence seized in the search and the legality of the search would have to be ruled on by a judge.
