Is it legal to back out of a judgement you signed if the judge didn't sign it yet?

I am in a custody/divorce/support case with my soon to be ex. We had an agreement that me, him and our attorneys signed. Now he is backing out. The judge didn't sign it but was involved with the details. He told us what wording to put and has seen us several times. Can my ex just back out though, he has signed it?

It all depends on how the agreement is worded and what it covers.

Generally speaking, an agreement of the sort you signed is valid and enforceable, BUT it may have been drafted in a way that made it not effective unless approved by the judge. In that case, your ex may well be able to back out.

Also, in most if not all states, an agreement concerning child custody, visitation and child support is ALWAYS subject to review and approval by the judge.


ask your lawyer...this stuff depends on where you live.
The lawyers have to get together with the judge and see if the agreement can be amended. Sounds like another court date.
