Yes--it was legal until the early part of the 20th Century. Pres. Lincoln smoked it. In fact, "Indian hemp" was one of his favorite things in life.
Once the federal government made it illegal, it has stayed that way.

Various states have legalized marijuana but the federal law against it means that the DEA can come in and arrest anyone in possession of it.
It was not made illegal until the middle of the 20th century.
