Can something that was on your credit report that has dropped off ( charged off) be put back on again?
in 93 we got married, had to break lease b/c of the woman under me treatened to kill me, we told the land lord. and they took it to court. i talked to the lawyer and never heard back from him, ( i thought it was settled) now 12 yrs later apparently a collection agency ( whom didn't let us know they were an agency till the next day after the initial call) told us that they have an old court order for $2700.00, now when we bought our house 2 1/2 yrs ago is wasn't on our credit report, nor was it on our credit report when we refinanced this yr in feb to pay off some old bills. can a collection agency go after us and put it back on our credit report? can they take 25% of my husbands wages? can they put a lien on our house? I always thought when it was charged off your credit report it can't be put back, is this credit agency double dipping?

Try reading this http://www.ftc.gov/os/statutes/fdcpa/fdc... especially section 807. The fact they misrepresented them self was a violation and you can file a complain with the FTC.
In order for it to be double dipping, the debt would have had to been settled. In my understanding, money owed can be sought, however there is a dispute resolution process with most of the credit reporting agencies.
Some outfits acquire old debt also in my understanding, for a lower price, and then attempt to collect.
I would also look into this company closely to ensure this isn't some type of scam.
The best thing to do would be to contact the agency trying to get the money from you anf find out how long they have been responsible for trying to get this money from you. Then find out who gave them rights to collect the money ask for proof ie: a court order contract signed by you detailed itemized list ext.) If you just want to get rid of this the most important thing to find out is the date collections started. You can contact the Fair Credit Reporting Agency and they will tell you your rights.It is also good and you may get more cooperation if you call them first and then call the collection agency so you know your rights and you can let the collection agency know that you have contacted the FCRA and you will report them for abusing your rights.
