My van gets me to work and back but is it a work van and does the smoking ban affect me in my van?

i use my van to travel to work and back does this mean that my van is a work van and is included in the rules and regulations set down by the smoking ban in work places or is it not
also i am self employed working on my own so if my van is a work van does it mean that as i do not travel anyone else with me can my van be excused from the smoking ban or not

If you only use the van to get to work and back and not actually for work then no it is not a work van therefore it is a private vehicle and exempt from the ban. However if you use it during work and have other people in the van then it is not exempt.

I would check with you health and safety rep or check your employee hand book, most companies have banned smoking throughout including all company vehicles.
If you are self-employed, the van you use to get to work is a work van. You are not allowed to smoke in it. I can't imagine anyone actually enforcing the ban - unless you happen to be a contractor for a local authority.

you can use the van going to and from work but you cant
use it for things like youre weekly shopping then again
you can use it for one off errands like stopping on the way
home to make a dental appointment also there is no smoking
allowed in a company van but who cares.

This could be an Inland Revenue inspector, MOT inspector, HSE Inspector, random ministry road-side check, police etc. (you get the picture). You may even get pulled over if a policeman spots you driving past him.

Considering the high number of commercial vehicle drivers who consistently flout the mobile phone ban your chances of being caught are small. Don't use me as an excuse if you are "done".

no. if the van belongs to you and it is your property then you can do what you want, its just like your car. the ban on work vans is meant to stop people smoking in vans and cabs oflorries that have passengers and helpers, for thier health, but the van has to be a business owned van, not yourown
