Can a company arrest your wages if you only receive Stat maternity pay, ie if off on maternity leave?
My partner is off on maternity leave, but doesn't receive any wages so only gets Stat Maternity Pay. Can this be arrested by a finance company?
Answers:
Since laws covering garnishment of wages and salary differ from state to state and situation to situation (ask O.J.) your best advice would be to contact a lawyer and discuss it. If you feel a lawyer visit might be too expensive for you then contact you local legal aid society.
In the US some types of pay are exempt from garnishment; we'd check with the local courts
The company would have to get a court order. By the time this happens, your partner might well be back at work.
As far as statutory maternity pay is concerned, this is exempt from an attachment of earnings deduction. See page 23 of this link. http://www.hmcourts-service.gov.uk/docs/...
