Overtime question?

my employer only pays overtime after 45hrs of work instead of 40hrs,is this legal??i drive truck for this company and i work 55hrs a week,is there anything i can do to require them to pay overtime after 40hrs?

It should be after 40 hours of work you are to be paid overtime. Unless you have a Union agreement or other contract. Report it to your state labor board. Keep track of all the time worked and how much you are owed. I did this once and the money owed to me was almost $2,000. Also had a labor board hearing with the company management present. It was fun to get in a few cheap shots at them. Afterwards it was as if nothing happened. Don't let this drop. Take action.

OT is for anything for 40 hours in a work week (although some actually pay for anything over 8 hrs/day). You need to report this employer.
I think you should check with your state guide lines, that typically are suppose to be posted at your place of employment. I'm guessing that's not a policy at your place of work so, check with your state department of economic security aka: Unemployment Department. Every state has one and they generally follow federal guidelines, which include overtime payment.

if your and hourly paid employee, they must by federal law pay overtime after 40 hours per week, 80 hours if paid bi-weekly. If your a salary worked, overtime does not apply
Call your local labor department. I think they are breaking the law. Only illegal immigrants work more than 40 hours and don't get OT.
