Search Warrant for violation of my privacy - Who can get the warrant? Please read details.?
I would like a judge to issue a search warrant for search of information on a website where I believe someone impersonated me online.
I am located in Virginia, the Website's office is in California. Well here are my questions:
------------------------------...
1) Can ANYONE get a search warrant for me? Or do I need to present legal authorities with my identification information? Meaning, can someone impersonate me to get a judge to sign a warrant?
2) Does a Virginia Judge have the jurisdiction to issue a search on a website located in California?
3) What procedure is usually followed to get the search warrant and how would the Website present the details of the search? Will they give the info to the police or to me personally?
PLEASE HELP! Thanks for your patience!
Answers:
Unfortunately, a private citizen can't get a "search warrant." These are tools made for the use of law enforcement. What you can do is sue the owner of the website for, amongst other things, fraud. Then the case enters discovery where you can subpoena records and materials. That's how a private individual would gain access to those materials.
