Emancipation?
Im 17 years old and I live in Florida. I live with my mother and i would like to get emancipated. Does anybody know how I can get emancipated? How long would it take? Where would i have to go or who would I have to talk to?
Answers:
In Florida this is called 'the removal of the disabilities of nonage'.
Here's the first item listed in the FL Statutes regarding this:
(1) A circuit court has jurisdiction to remove the disabilities of nonage of a minor age 16 or older residing in this state upon A PETITION FILED BY THE MINOR’S NATURAL OR LEGAL GUARDIAN OR, IF THERE IS NONE, BY A GUARDIAN AD LITEM.
So, are your parents going to file the petition?
Even if they're willing to do that, you'll still have to meet all the requirements for it. You’d have to provide the court with a *valid* reason why emancipation would be in your best interest (reasons such as not liking your parents rules or wanting more freedom aren’t valid reasons). You'd also have to provide proof that you can fully support yourself--paying for rent, utilities, food, medical expenses, etc--with no assistance from anyone (just fyi…that does not mean moving in with someone else and depending on them for help/assistance). The court is also going to want to see that you can do this while remaining in school. There could be other requirements as well, and the court can deny your request for any reason that they see fit, including, but not limited to, their belief that you lack the maturity to function as an adult.
Emancipation is *rarely* granted in any state. And as others have mentioned, it takes time (all legal processes do), so you might be 18, or right at it, before it even gets to court.
EDITED TO ADD THIS AFTER YOU ADDED ADDITIONAL DETAILS:
Just FYI...suffering from depression and being bi-polar is not going to help your case. At a minimum the court will want to see that you are under a doctor’s care, that you are following the doctor's orders, and that you have the financial ability to remain under the doctor’s care. So, that means you either have to be able to pay for it on your own (along with all your other bills) or you’ll have to your own insurance (not your parents insurance) that will cover it. Remember--no help from anyone, and that includes the taxpayers (not that you implied that you would expect the taxpayers to pay for it, but I’m just saying…)
Simple answer...
Wait one year and you are free to do as you please. By the time you go through the process you will be 18.
don't you like being a dude?
lol... no just wait a year man...
wait until your 18 and you'll be free to do what you like with your life...
You would be 18 by the time it could be done through the legal system. So just hang in there.
Join the military. ( your mother will have to sign consent papers)
If you graduate High School and are still 17 you can ship to boot camp. If you are Military and 17 yrs old you are still a legal adult.
Then you'll have a place to stay, get paid and free food.
That's the only way I know when I was in I had a 17 year old in my platoon.
Why the hell would I get a thumbs down?
I agree withthe fellow above me. The services are your quickest way out. The court system will take much longer. You must first graduate H.S. and have your parents sign a consent form.
The one thing may mey disqualify you for the service is this Bi-polor thing. Is that a clinical diagnosis? Or just something your mother told you? If it is a clinical diagnosis, the services won't take you.
