I've been selected to Grand Jury for 6 months. What are my rights as far as my job/Benefits, pay?
My boss is threatening to cut my Blue Cross & not pay me for the time I missed because of being selected for jury duty. If I do not work 30 hours a week I have to buy Cobra Insurance and won't get paid lost hours although I volunteered to come in after 5:00 and on Saturdays. She doesn't want that. I'm doing my civic duty and it's costing me plenty. What can I do?
Answers:
It depends on your state's laws.
"The Fair Labor Standards Act (FLSA) does not require payment for time not worked, including jury duty. This type of benefit is generally a matter of agreement between an employer and an employee (or the employee's representative). The Bureau of Labor Statistics' (BLS) Employee Benefits Survey indicates that 87 percent of employers offer paid leave for jury duty service. While federal law does not, some state laws require employers to pay employees who are asked to serve jury duty."
Talk to the judge.
You may not be able to get out of jury duty, but your boss has no right to retaliate because you've been pulled away for it.
There are laws to protect an employee if an employer tries to retaliate for jury duty. Consult an attorney who specializes in employment law.
Call the jury services department, they can excuse you from service if it would be a financial hardship and risk your job.
