My step dad broke his leg while playing with neighborhood kids.?

He was on a bike near a park and train tracks. He was playing with his son and other kids when he fell and broke his leg in half. Is there anything here? He will miss work for 8 months because he now has a rod in his leg. There are no "no trespassing" signs or anything. Can there be a law suit here?

Answers:
You want to sue because your step dad is clumsy? No wonder why this country is going to the dumps.

Probably not. It depends on if he hurt his leg due to the landowner, or something unsafe on the land. If he just fell, then no lawsuit.
There might be a suit, but it will be difficult to win, I think. You should talk to a personal injury lawyer, there are a lot who work on contingency -- look in the yellow pages or call the bar association for a referral. A lawyer in your area is better equipped to review all of the facts and tell you how good your chances are.
Falling and breaking his leg is no one's fault but his own. A lawsuit is about negligence on the other party. Where is the negligence but on your step-dad. Sounds like he took a serious fall; but the issue is what was he doing to have taken a fall to injury himself badly? "playing" ?
No. It was an accident.
