Legal question: If your spouse is an alcoholic and drinks to the point that he is nearly comatose?
And I have power of attourny, and he is in such bad shape, does not know his last name, who the president is, what day it is and what town he lives in, why won't the EMT's take him to the hospital even when he cant ask the questions asked to see if he is orriented? And what can I do legally to help him?

I don't know what type of POA you have, but consult an attorney to decide if it is strong enough to commit him out of fear for his own safety. He will die without your help, and can you imagine the guilt you would carry with you if you did not intervene? Wouldn't you want someone to do the same for you? I would. Good luck. CHEERS!

I'm sure you wouldn't, it sounds like you are genuinely concerned for his welfare, but I felt compelled to comment on the post above mine.

First- In most states EMT's do not have the authority to remove a drunk unless there is some other physical injury. Then they will take him to a hospital and chances are your health insurance will not pay for the visit and you will be stuck with the bill. A one way ride in an ambulance carries a minimum $500. charge where I live.
See if there is a alcoholic treatment center near you and see if he can get in. That will cost you too so be careful. Talk to his family, brothers, sisters and parents if you can, see what they say. Visit your local AA Chapter and ask them for advice and help!!

If you have a general (or specific) POA and not a medical POA then the EMTs (or even the police) are correct in not honoring it. That POA is for the 'affairs' of the grantor, not the body of such.
To be able to admit him into a treatment or medical facility, you would require a MEDICAL POA.
I would suggest you discuss this matter with a local family law attorney to see if you can show cause to petition the court for conservatorship over him so that you can get him the help he may need.

Do yourself a favor, today start removing your finances from his and making a plan to have a life of your own. Alcoholics not only destroy their own lives, but the lives of people who love them. The alcoholic will not change, he will continue to drag you down until you find yourself at an age where you have nothing left. Please, get out.

You should really get a divorce. My father was a heavy drunk. And when he got really drunk one time. He bit my mother. But then she left him. To show me, and my younger sister that you don't take crap from no man. And no one should go through that at all. So look you can get him pamphlets, and brochures. But he has to want to change. But if he doesn't, think of your self. He could hurt you really badly. So help him get the help he needs, and leave him. If it 's meant to be God will bring it back. Hope this helps. G.B.
