What steps can i take to prove my step-father and i had a father son relationship?

Here's a brief summary my mother died 2months before my step-father both had no will in the state of N.J. I was made adminstrator of both Estates. Because my step-father has no children just myself from age 3-16 my lawyer wants me to find any documents with him showing that he was acting as my father. I 've been to my old highschool and they only have transcipts showing that i was living at my parents address...everything else was destroy because it was so long ago ( i am 36) I was thinking could i possibly contact the IRS because i was living with them when i was a minor because i'm sure they would have claim me on their taxes? My step-father had life insureance with AARP and changed me to the beneficary after my mother died and that has his signature would that count for anything and the fact that he made me Power Of Attorney when he was alive? He didn't like his family when he was alive and because my mother died before him they want to take everything including her house.

Can you request any paperwork where he was listed as legal guardian; for example, the school you went to, any camps, he may have signed when you got your drivers license, emergency contact information on any forms, listed as your guardian or parent at the physician office/dental office, did he cosign any loans, claim you as a dependent on his income tax, get any credit with you jointly, etc.Good luck.


How about if he claimed you on his health insurance plan
Testimony from friends and relatives. Pictures at family functions, outings, ect. I think pictures of fishing trips and such could offer powerful proof.

Did he introduce you to others as his son? (You'll need to get their testimony.)

Did your parents send family greeting cards to friends and relatives with greetings like from Bob, Margie, and David for example. Do you have birthday or Christmas cards, ect that say "To my son" or something similar that has your father's name on it?
This should be evident from your mother and step-father's marriage license. It would have the date they got married and this, along with your birth certificate, would should that you were of age to be living with them. Also, notarized statements from neighbors, friends and relatives would attest to the fact that you lived with him and your mom and he was acting as your "father."

If your mom owned her house, if it was in her name, you SHOULD be the benficiary to her things, her house, etc.

On your medical records, ER visits, etc., did he ever sign for anything there...or did he have to co-sign for a car for you? Did he ever give written permission for you to play in sports in high school?

The tax records should show something or his W4 forms from work, perhaps, or W2s. I would get something notarized from relatives or such that you lived with him as a minor.

Maybe someone else here can think of something else. Let this be a lesson to you to get your own will made to avoid this kind of thing in the future.
