If your mom has a court order that says you're not allowed to be with your dad until you're 18, then legally she can make you come home. However, you're 16 years old and most courts, if not all, will listen to what you want and let you decide which parent to live with. You need to contact a lawyer and get a court date. I would suggest finding the number of the legal aid department in your county and contacting them. I'm sure they could provide you with an attorney free of charge or at least tell you what steps you need to take in order to get it done. Good luck!
According to Texas law, at the age of 13 a minor can decide which parent to live with. Contact the attorney generals office and ask them these same questions.
if your mom has sole legal custody then she can do that. however being your 16 you can go to court and if the court decides your mature enough to make your own decisions then you can pick where you want to live.
We do not have enough details. But a court order is an order. Not a suggestion.
Prove your mother is an incompetent parent. This may be hard if she can provide for you, but if you can prove that she is emotionally abusive to you, you should be able to stay with your dad... It'd be a plus if your dad can provide better for you than she can too...
Your parents have real issues. You as a minor, have no rights. If your mom has custody, thats pretty much it. If there is a court order you cant be with your dad until you are an adult, if you go to your dads, he is in violation of that court order. Big trouble. My advice is to stay away until you are "Of age". Call, email etc. Just dont get him in trouble.
Google "emancipation age" for your state and see if you have a possibility of being declared emancipated from your custodial parent.
What reason did she give the court for not allowing you to see your dad? Had to be something for the court to agree.
Regardless: you are a minor. You have practically no rights in this regard. Sorry - that's the way it is. I didn't make the rules.
Do your parents have joint custody? Are you saying your mother is the custodian parent? If you chose to live with your father and the court ordered against it .Why do you think they would did that? They always try to do what is best for the child.
